In past forums, there has been some argument about whether Vibracell is a brand, a material, or a process. For instance, now that Switch Music is defunct, could other companies make a Vibracell guitar? or is that a name Switch made up for their own lines? But if it's something Switch licensed from elsewhere, who owns the rights? and what factory had the ability to create these?
I am not a lawyer, but it seems to me that freely using the same term across patent AND trademark AND copyright would be considered to cloud the value, the sort of thing that causes corporate attorneys to turn various purply shades & then increase their billing rate.
